Trump’s legal tactic of pursuing delays and elevating smoke-and-mirror sideshows has dramatically increased the odds that any halt of his ascent to the presidency will instead have to come from voters at the ballot box in November. Many experts agree that was Trump’s principal legal “strategy” from the outset. CNN —The Supreme Court will likely produce thousands of words when it decides this year whether former President Donald Trump may claim immunity from special counsel Jack Smith’s election subversion charges. Every time the Supreme Court grants an appeal it settles on a specific legal question to resolve. In the immunity matter, the court didn’t embrace Trump’s framing – nor the question Smith posed when he sought review on the same issue in December. “The question implicitly rejects Trump’s position of absolute immunity because of that language ‘whether…and to what extent,’” Eisen said. By taking the appeal, the Supreme Court has effectively pushed back the start of a trial in the federal election subversion case by weeks, at least.

The House Ethics Committee investigating Rep. Matt Gaetz has reached out to the woman whom the congressman allegedly had sexual relations with when she was a 17-year-old minor, according to a source familiar with the committee’s work. The federal probe, which also included allegations he had sex with a minor, concluded in 2023 with no charges brought against the congressman. The increased activity under Republican leadership is notable given the committee probe was started by House Democrats in 2021. But McCarthy has repeatedly denounced those accusations and has said Gaetz worked to oust the former speaker because of the ethics probe. The probe expanded over the years before the Justice Department officially decided last year not to charge the congressman.

CNN —Donald Trump’s legal troubles deepened earlier this week when he was informed by special counsel Jack Smith that he’s the target of the criminal investigation into the aftermath of the 2020 election – the clearest sign yet that the former president could soon face more criminal charges. But without more detail, it’s hard to know exactly what shape the charges will take or what Trump 2020 election-related conduct they are aimed at. Among the potential charges Trump has been warned about is one pertaining to witness tampering, according to the Wall Street Journal and other outlets. Trump’s alleged involvement in a criminal conspiracy has been invoked in the litigation around the House select committee that investigated January 6’s pursuit of Trump lawyer John Eastman’s emails. That ruling pointed both to the obstruction of an official proceeding statute and the general conspiracy statute.

The network faces two separate defamation lawsuits from voting technology companies that collectively seek $4.3 billion in damages. Cases against FoxDominion Voting Systems is suing Fox News and Fox Corporation for $1.6 billion, accusing the network of spreading false claims that its technology enabled election fraud. A separate, similar case brought by voting technology firm Smartmatic is seeking $2.7 billion in damages.
